Rationale
The Green Innovation Corridor (GIC) is a major regeneration project in Wolverhampton, aimed at creating an Innovation District focused on green construction, engineering, and digital technologies. Phase 1 of Six Mile Green (SMG) identified the requirement to obtain biodiversity credits in order to facilitate the enabling works at plots 1 and 2 which are overgrown brownfield sites. This is because the construction of the planned development will not achieve the statutory requirement of 10% net gain of biodiversity on site. The designs approved by the Local Planning Authority (LPA) 25/01020/FUL on 22 January 2026 seek to clear and level both plots of land to prepare them for development. The planning permission requires the Council to discharge pre-commencement planning conditions associated with Biodiversity Net Gain (BNG). Due to the ecological impact of the site clearance, payment of said credits will be the first thing required before any site works can begin. These credits are paid to a registered Habitat Bank Operator (HBO) to secure and develop off site habitats on a like for like basis to what is lost on the SMG sites for a 30-year period which is in accordance with national legislation requirements. The current SMG Professional Services contract does not include provision for: •procuring the required BNG off site credits •undertaking the necessary due diligence •coordinating with registered HBO •preparing the necessary evidence and submitting the required documentation to the LPA to discharge the planning condition To ensure compliance with planning conditions and avoid delay to the programme, the contract must be varied to include this additional scope. Turner and Townsend are already leading the technical assurance and planning compliance work for the SMG enabling works package and therefore are best placed to undertake this additional activity efficiently and within the existing project governance structure. In accordance with Schedule 8 of the Procurement Act 2023, a modification can be made on the following basis: Unforeseeable circumstances 4(1) A modification is a permitted modification if - (a) the circumstances giving rise to the modification could not reasonably have been foreseen by the contracting authority before the award of the contract, (b) the modification would not change the overall nature of the contract, and (c) the modification would not increase the estimated value of the contract by more than 50 per cent.
