The proposed modification is considered permissible under Regulation 72 of the Public Contracts (Scotland) Regulations 2015. The modification is necessary because: The Council must ensure continuity of statutory funded childcare provision. Immediate replacement through an alternative procurement route is not practicable. The modification is temporary and proportionate. The overall nature of the contract remains unchanged. This is to continue the existing arrangement with Kidz-World from 1 August 2026 until the earlier of Admission to the new DPS following the November 2026 application round and completion of any required award process; or 31 December 2026, whichever occurs first. This period is considered the minimum necessary to bridge the gap to a compliant procurement solution.

There are currently 48 children accessing statutory funded childcare provision through this provider The service has advised that: Immediate termination of provision would significantly disrupt childcare arrangements for children and families. Alternative providers are unlikely to have sufficient capacity to accommodate all affected children within the required timescales. Continuation of provision is required to support delivery of the Council's statutory duties in relation to funded ELC. Failure to maintain continuity of service would present operational, reputational and service delivery risks for the Council.
