Why this procedure was chosen
The justification for this decision, as required by relevant regulations, is that the Council is satisfied that: • the modification is clearly and unambiguously provided for in the contract • the modification does not render the contract or framework agreement materially different in character, and; • less than 25% of the lifetime value of the original contract or framework agreement when it was entered into or concluded. • the modification has been assessed under Regulation 13, which governs when healthcare contracts may be modified during their term without triggering a new procurement process. • the modification is necessary to ensure continuity of a critical health service, avoiding disruption that would negatively impact patient outcomes. • no alternative provider is realistically able to mobilise the service without risk to continuity; therefore, a competitive process would not offer additional value and may compromise service stability.
