Opportunity overview

Nottinghamshire County Council is procuring a Framework Agreement for the provision of residential and/or nursing care home services for adults. The Council intends to appoint multiple successful bidders as Providers under the Framework. The Framework will support individuals whose primary support needs include learning disabilities, autism, mental health needs, physical disabilities, brain injuries and sensory impairments. Services may include standard placements, short breaks, emergency placements, forensic provision and exceptional and highly specialist care arrangements. The service is primarily for adults. The Council may also use the Framework to commission provision for young people aged 16 or 17, provided that the relevant home satisfies all applicable registration, policy and regulatory requirements, including those of the Care Quality Commission and/or Ofsted. For older adults, typically those aged 65 and over, the Council will ordinarily commission residential provision through alternative contracts that the Council has developed specifically for residential care for older adults. It is anticipated that this Framework will only be used for people aged 65 years and over in exceptional circumstances where suitable provision cannot be identified via the alternative contracts. Most placements are expected to be within the seven districts of Nottinghamshire. However, the Council may commission placements outside of Nottinghamshire where required. Bidders are advised that, following the UK Government's publication of the English Devolution White Paper in December 2024, a programme of Local Government Reorganisation ("LGR") is underway which may affect the governance, boundaries and/or legal status of the Council during the term of any Framework or Call-Off Contract entered pursuant to this procurement. As a consequence of LGR, any Framework or Call-Off Contract may be required to be transferred, assigned or novated (in whole or in part) to one or more successor authorities or other public bodies established as part of LGR, in accordance with applicable legislation. The Council intends to establish this Framework for an initial term of 6 years, with the option to extend for up to two further periods of 24 months (6+2+2). The maximum potential duration of the Framework is therefore 10 years. Appointment to the Framework does not guarantee a Provider any volume of placements or minimum level of expenditure. The Council reserves the right, at its discretion, to advertise one or more further opportunities to admit additional Providers to the Framework. No dates have been set for any such opportunities. Any future opportunity will be separately advertised and conducted in accordance with the applicable procurement requirements. A bidder that is unsuccessful in this procurement may submit a new tender in response to any future advertised opportunity but a bidder that has been successful will not need to re-apply. For the avoidance of doubt this Framework is not an Open Framework within the meaning of the Procurement Act 2023. Full details of the requirements are set out in the procurement documents.

Bidders acknowledge and accept that the Council must comply with all statutory, regulatory and other legal requirements arising in connection with LGR and, to the extent necessary to do so, reserves the right to make such amendments to the procurement arrangements and/or any resulting Framework or Call-Off Contract as are required or permitted by law. Bidders must submit their tender on the basis that such transfer, assignment, novation or amendment may occur and that no additional charges, price adjustments or termination rights shall arise solely as a result of LGR. Any reasonable steps taken by the Council or a successor authority to notify Bidders of matters arising from LGR shall be sufficient for the purposes of this procurement.

Description
For the Framework Agreement all bidders meeting the minimum quality threshold of 60% and assessed as meeting the Conditions of Participation will be selected for award. Awards of Call-Off Contracts under the Framework will be made using one of the following approaches: • Direct Award; or • Further Competition. Circumstances for Direct Awards A Direct Award may be made in any of the following circumstances, subject to the requirements set out in Schedule 2 of the Framework: a) Emergency Placement Where the Council has fewer than 72 hours to secure a placement because of an immediate risk or urgent need. Emergency Placements are exceptional and time-limited and must not be used for routine or planned placements. The award of Emergency Placements will be facilitated by the Service Profile Summary provided by each bidder when they join the Framework which includes, but is not limited to, details of 'core costs' for each care home. b) Transfer of an Existing Placement Where a Service User is already in an established placement commissioned by an Integrated Care Board, another commissioning body or another local authority, and responsibility for commissioning the placement transfers to the Council. This route may only be used where it would not be proportionate or appropriate to undertake a Further Competition and it would not be in the Service User's best interests to move or re-procure the placement. c) Individual Service User Choice Where a Service User has expressed a clear and informed preference for a specific Provider and the Council considers it appropriate to support that preference. This route may only be used where the Council is satisfied that the Provider can meet the Service User's assessed needs and the applicable requirements of Schedule 2. All Direct Awards must be appropriately justified and approved and are subject to the due diligence, quality, pricing, value-for-money and contracting requirements set out in Schedule 2 of the Framework. Circumstances for further competitions A Further Competition may be undertaken where: • A planned placement is required • More than 72 hours is available to secure the placement • Following the completion of an emergency placement period, ongoing support is required • There is a requirement for a block arrangement for the placement of more than one individual The evaluation criteria will be based on criteria defined at the Further Competition ITT stage. Quality award criteria may vary in weighting between 25% and 100%. Price award criteria may vary in weighting between 0% and 75%.
