Opportunity overview

This is a notice under the Health Care Services (Provider Selection Regime) Regulations 2023 (PSR 23). The contract was awarded Under the Public Contract Regulations 2015 (PCR 15) but is now governed by the Provider Selection Regime. The modification is allowable under the Provider Selection Regime Reg 13(1)(d). In accordance with this provision, the modification is made at the discretion of the Council and it does not render the contract materially different in character. The modification is to add new funding for existing services provided under the contract. The proposed modification will add £1,807,545. The total amount of additional funding was confirmed early 2026. The additional funding comes from: · Drug and Alcohol Treatment Recovery and Improvement Grant (OHID) · Safeguarding Families Together (SFT - DC Children Services) · Criminal Justice Service (Office of Police and Crime Commissioner) · 2% uplift to the original core contract value agreed by Commercial Board on 27 February 2026 · Adding the Individual Placement and Support Service into the core contract following advice from legal services that this was in keeping with the service specification The government announcement of grant awards are outside of the commissioner's control and the variation to include these services and funding amounts will not render the contract materially different. The grant funding is specifically for the services commissioned from the provider under the existing contract so it is appropriate for the funding to be added to the value of the existing contract.

Rationale
Need for additional works, services or supplies by the original contractor/concessionaire: The risk of not modifying the contract is that the services would not be provided within the time limit and parameters of the grants which have tight delivery times. In addition if the modification was not granted and a procurement exercise was required the risk to service disruption would be greater. The only other option is to return the grant money, which would prevent services from developing as planned and lead to worse outcomes for people needing treatment for drug and alcohol use. This would pose a financial and reputational risk to the the Council.
