- Rationale
- Need for additional works, services or supplies by the original contractor/concessionaire: The proposed modification is considered necessary under Regulation 72(1)(b) as the additional lighting requirements within the Our Cultural Heart (OCH) area form an integrated extension of the existing Christmas illuminations scheme delivered under current contract.
The OCH installation is located within the same town centre environment, programme, operational footprint and public-facing festive lighting offer as the existing contract. Appointing a separate contractor would require duplicate project mobilisation, site surveys, structural and electrical assessments, method statements, risk assessments, traffic and pedestrian management considerations, stakeholder liaison, installation programming, supervision arrangements, testing, commissioning and removal activities for the same festive lighting scheme.
Procuring and managing a second supplier would also create significant operational complexity and additional cost through the need to coordinate overlapping installation and dismantling programmes, manage contractor interfaces, allocate responsibility for shared infrastructure and town centre locations, and resolve any conflicts relating to design, programme delivery, health and safety responsibilities or public liability. The Council would incur additional officer time in procurement, contract mobilisation, performance management and operational coordination, whilst also increasing the risk of delays, inconsistent quality standards and disruption to the delivery of a single cohesive town centre lighting scheme.
The existing contractor already possesses detailed knowledge of the infrastructure, asset locations, electrical supply arrangements, installation methodology and operational requirements associated with the Kirklees Christmas illuminations programme. Utilising the incumbent supplier therefore avoids the additional costs and practical difficulties associated with introducing a second provider into an established and interdependent scheme, ensuring efficient delivery, continuity of service and clear accountability for performance. The proposed modification represents an extension of existing services rather than a new standalone requirement, and the value of the modification remains below the 50% threshold prescribed under Regulation 72(1)(b).
