Why this procedure was chosen
The contracting authority is applying Section 41 of the Procurement Act 2023, relying on the lawful justification set out in Schedule 5, Paragraph 5. Home Group Ltd possesses exclusive rights arising from its long-term leasehold and legal interest in the accommodation units required for delivery of the Supported Temporary Accommodation service. Under Schedule 5, Paragraph 5(a)–(b), only the rights‑holder can lawfully permit service delivery within these premises, and no reasonable alternative supplier or site exists. This is confirmed by market engagement and soft‑market testing, which demonstrated that no other provider could supply the required service without acquiring those property rights.
